THE PUBLIC PRESENT:

Approximately 9 members of the public were in attendance.

     

 

CALL TO ORDER:  Chairman of Council, Eugene R. Baten, called the meeting to order. 

INVOCATION:  Councilwoman Vivian Fleming McGhaney gave the invocation. 

PLEDGE OF ALLEGIANCE:  All in attendance repeated the Pledge of Allegiance.                                  

APPROVAL OF AGENDA:  Chairman Baten asked the Clerk to Council if there were any adjustments to the agenda.  The Clerk stated that there were no adjustments to the agenda; therefore, the Chairman called for a motion to approve the November 27, 2012, agenda.    

ACTION:  MOTION was made by Councilman Baker, seconded by Councilman Byrd, and unanimously carried by Council to approve the November 27, 2012, agenda as presented. 

MINUTES:  REGULAR MEETING HELD ON NOVEMBER 13, 2012:  Chairman Baten stated that he would entertain a motion to approve the minutes of Sumter County Council’s regular meeting held on November 13, 2012.  

ACTION:  MOTION was made by Councilman Baker, seconded by Councilwoman Sanders, and unanimously carried by Council to approve the minutes of the regular County Council meeting held on November 13, 2012, as presented.

LAND USE MATTERS AND REZONING REQUESTS -- None

Development/Rezoning Request –

Street Name Change – None

Grant Awards -- None

OTHER PUBLIC HEARING:  None

NEW BUSINESS:

(1)   It May Be Necessary To Hold An Executive Session To Discuss A Personnel Matter, Receive A Legal Briefing, Or Discuss A Contractual Matter And Appropriate Actions May Be Required And Taken Thereafter

No executive session was held. 

OLD BUSINESS: 

(1)   12-781 – Second Reading -- An Ordinance Ratifying The Existing Multi-County Park Agreement Between Sumter County, South Carolina And Lee County, South Carolina Enacted In Sumter County By Sumter County Ordinance No. 96-299, As Amended By Sumter County Ordinances 96-308 And 96-310; Ratifying The Existing Park Boundaries And Authorizing The Execution And Delivery Of A Revised And Restated Multi-County Park Agreement.

The County Attorney stated that this is second reading on an ordinance to amend the agreement that the County currently has with Lee County concerning the multi-county park agreements.  This ordinance amendment will bring Sumter County’s agreement with Lee County into line with the agreements the County has with Kershaw and Clarendon County.  There have been no changes since first reading.    

ACTION:  MOTION was made by Councilman Edens, seconded by Councilman Baker, and unanimously carried by Council to grant second reading to this proposed ordinance as presented. 

COMMITTEE REPORTS:

(1)   Internal Affairs Committee Meeting To Be Held On Tuesday, November 13, 2012, at 4:00 p.m. In Sumter County Administration Building, County Council’s Conference Room (Byrd, McGhaney, and Sanders).

The Chairman of the Committee, Councilman Byrd stated that the Committee met; however, no recommendations were made. 

(2)   Personnel/Technology Committee Meeting To Be Held On Tuesday, November 27, 2012, at 4:30 p.m. In Sumter County Administration Building, County Council’s Conference Room (McGhaney, Byrd, and Sanders -- All Council Members Are Asked to Attend)

The Chairman of the Committee, Councilwoman McGhaney, stated that the Committee met and discussed matters relating to employees that are eligible to retire and matters relating to upcoming changes in State Government concerning the TERI Program. 

Secondly, the Committee discussed the County’s Employee Handbook.  No action is required. 

 (3)  Fiscal Tax, and Property Committee Meeting To Be Held On Tuesday, November 27, 2012, at 5:00 p.m. In Sumter County Administration Building, County Council’s Conference Room (Baten, Blanding, and Edens -- All Council Members Are Asked to Attend). 

The Chairman of the Committee, Chairman Baten, gave the following report and recommendations from the Committee meeting. 

  • Contractual Matter Pertaining To Property – No action was taken; however, the Attorney was asked to develop an ordinance which would satisfy this project. 
  • Discussion Concerning A Restrictive Conveyance At Dillon Park.  The County Attorney briefed Council about this venture, and he stated that he would prepare an ordinance which would satisfy the needs of the Restrictive Conveyance at Dillon Park. 

 (4)  Forfeited Land Commission Meeting To Be Held On Tuesday, November 27, 2012, at 5:30 p.m. Or Soon After the Fiscal Tax And Property Committee Meeting Is Concluded In Sumter County Administration Building, County Council’s Conference Room (All Council Members Are Members Of The Commission). 

During the Forfeited Land Commission Meeting, the Commissioners meet in executive discussion to discuss several potential contractual matters.  At the conclusion of the executive session, the Commissioners voted to authorize the County staff to sell the property on 221 Cedar Street to Mr. Harmon Pinckney at a cost to be determined after research with the County Treasurer and others pertaining to taxes, penalties, and fees. 

(5)   Report From Council Members On Other Meetings, Trainings, And/Or Conferences

  • Vice Chairman Blanding attended the Base Realignment And Closure Taskforce meeting.  The material that was presented at the meeting was electronically sent to members of Council by the Clerk to Council. 

MONTHLY REPORTS:

  • The Annual Christmas Tree Lighting Program will be held on Friday, November 30, 2012. 
  • South Carolina Association Of Counties Annual Legislative Meeting – November 28-30, 2012.
  • Chamber of Commerce Retreat, February, 2013.
  • Ribbon Cuttings – Virtual Enterprise
  • Legislative Breakfast – Chamber of Commerce Sponsoring this event at the Health Science Building, December 12, 2012.
  • SWRTA – Drop In For Ann August, December 6, 2012. 

COUNTY ADMINISTRATOR’S REPORT:

  • SCAC 2013 Lobby Days
  • Legislative Day for the Chairman of Commerce is March 6, 2013
  • Norma Timmons, staff member of 18 years, will be retiring on December 21, 2012. 

PUBLIC COMMENT: 

The Chairman asked if anyone wished to speak during public comment; no one spoke during public comment

ADJOURNMENT

There being no further business for Sumter County Council, and no additional comments from the public, the meeting was adjourned at 6:13 p.m. after a motion by Councilman Baker, seconded by Councilman Byrd, and unanimously carried by Council.
